DIRECTOR'S LIABILITYLegal expenses for any suit against the CFA Board are covered by director’s liability insurance.
REALTORSRealty Signs are not permitted on CFA property. Real Estate salespersons are permitted inside CFA with approval.
BUILDING CONTRACTORSAll contractors are approved by the Architectural Review Chairman and the CFA Board. They must also have a valid contractor license and insurance.
ANNUAL ELECTION BALLOTSCFA uses absentee ballots that have been approved by legal counsel.
ARCHIVESBallots will be retained for 1 year.Financial records will be retained for a minimum of 7 years. The Board of Directors and the Treasurer must approve the destruction of records.
NEWSLETTERThe Board of Directors prepares a periodic newsletter, which is mailed to each Member.
RESPONSIBILITY & LIABILITYUse of CFA facilities is at user's own risk. Carolina Forest Association, Inc. is not responsible for death, injury, or property damage resulting from such use.
MEMBERSHIP FEESMembership fees are billed annually and are due on Jan 1st.Unpaid fees incur late charges on March 1st.
MEMBERSHIPOwners who have paid all fees and assessments are Members of the Association and are entitled to the benefits and privileges of such status as defined in the Association Bylaws, including the use of CFA amenities.
Habitation of temporary structures, unfinished dwelling, vehicles, campers, trailers and the like is not permitted within Carolina Forest except 1) in those areas specifically designated for such purpose and 2) a Recreational Vehicle may be used on an improved or combined lot for up to two weeks if it is needed for guests.
The Association has an unsecured Storage Area near the maintenance building where Members may store boats, trailers, campers, or other equipment for a maximum of one year.Members must register stored items at the Association office with a description of the item, including registration numbers and an emergency telephone number for the Member.At the end of one year, the Member must re-register the item or remove it.
CFA may remove and dispose of unregistered or abandoned items in the Storage Area.
The Association is not responsible for any damages to, or theft of, boats, trailers, campers, or any other items or parts thereof stored in the Storage Area.
No vehicles or trucks may be parked or stored in the Storage Area.
Only Members are permitted to use the Dumpster and/or Recycle container.The dumpster is located beyond the campground entrance gate on the right side of the road; the Recycle container is on the left side of the road.
This dumpster is for household trash only.Building materials, appliances, furniture, yard trash, etc. are not permitted.The Recycle container is for plastics, cardboard, aluminum, metal cans, glass bottles, etc.
Cardboard boxes and other bulky waste must be flattened before being placed in the Dumpster/Recycle container.
Each Member is asked to help keep the Association clean by picking up and disposing of any trash on the ground around the Dumpster/Recycle container.
All Owners planning construction of any kind must notify the CFA Office and pick up a construction package. This package is self-explanatory and will help the Member understand the proper procedures to follow before and during construction.
Members are expected to have current stickers on their vehicles indicating that they are Members of the Association.If the vehicle does not have a current sticker, the occupant must use his/her gate card to open the gate.In the absence of a current sticker and a gate card, the occupant must fill out a Guest Pass.
Members must notify Security when they are expecting guests or service people.Members who neglect to notify Security may have such persons turned away.
Members who have regular guests or service people coming to their homes may list such names with Security rather than notifying Security each time such persons are expected.
In case of an emergency, Members should call Security to let them know that an emergency vehicle is coming to CFA.
Owners of property in Carolina Forest who are Non-Members must personally let their visitors, guests and service people through the gate.
Only Members eligible to vote, as defined in the Bylaws, or their spouse, may give permission to guests to use CFA recreational facilities.
Any Member giving permission to guests to use CFA recreational facilities assumes full responsibility for the conduct of their guests.
Any guest not accompanied by a Member must possess a letter signed by the Member giving the guest permission to use the CFA recreational facilities for that day and date only.
As to the use of the pool, guests of a Member shall be limited to six (6) persons at any one time.
Guests of a Member shall be limited to one boat space at a time in the temporary boat slip area of the marina.
Guests entering the Association with towed watercraft must pay a $10.00 Guest Watercraft fee at the main gate.
Renters are defined as persons renting dwellings from CFA property owners.
Renters must register at the CFA Office and provide a copy of the lease to be on file at the Association office.
Renters may obtain a maximum of two (2) gate cards at a cost of $25.00 per card upon submission of proof of tenancy. Upon return of the card(s) within one year, one-half of the cost will be refunded.
Renters may purchase access to CFA amenities for a fee determined by the Board of Directors. See the Renter Amenity Policy. I the renter does not pay the renter amenity access fee, renters are allowed access only to their rental property and are not permitted to use the amenities.
Renters must obey all CFA rules, regulations, and bylaws. Violations may result in revocation of privileges for the renter or legal action against the renter and owner/lessor.
Vehicle stickers may be purchased at a cost of $5.00 each (maximum 2) if the owner/lessor is a Member
Two (2) gate cards are issued to each owner who is a CFA Member. Two (2) additional gate cards may be obtained at the CFA Office by CFA Members for $25.00 each. The gate cards of owners who are CFA Members will provide access to all gates in Carolina Forest.
One (1) gate card is issued to each owner who is a Non-Member. One (1) additional gate card may be obtained at the CFA Office by Non-Members for $25.00 each. The gate cards issued to Non-Members provide access only to the gate leading to their property.
Anyone with extenuating circumstances requiring more than the permitted number of gate cards must submit a written request seeking board approval.
Two (2) vehicle stickers are issued to each Member when the current year’s fees are paid. Two (2) additional stickers may be purchased at a cost of $5.00 each. Members requiring more than four (4) vehicle stickers must submit a written request seeking board approval. A Member who disposes of a vehicle and needs a sticker for another vehicle can switch the sticker to the new vehicle or bring it to the office for a replacement.
Mailboxes are available at a one-time charge of $25.00. Owners requiring a mailbox will need to fill out the required paperwork, which is available at the CFA Office, prior to the post office box being issued.
CFA maps are available at a cost of $1.00 each.
Marina decals for watercraft are available at the CFA office at no charge.
Golf Cart, ATV, and other off-road vehicle decals are available at the CFA Office at no charge
Unattended vehicles and equipment must be parked on the owner’s property. Parking of vehicles and/or equipment on CFA property, roads, rights of way, and property owned by others without written permission is not permitted. In the event of a violation, a Notice will be sent to the owner and posted on the vehicle or equipment. If the violation is not remedied within fifteen days of the Notice, CFA may remove the vehicle or equipment. Any costs incurred may be levied against the property owner and may be collected in any manner in which annual fees may be collected.
Failure to maintain lot(s) in a tidy manner will result in a Notice sent to the offending owner. Failure to rectify the violation may result in maintenance of the lots by CFA. Non-operating and unregistered (unlicensed) vehicles must be garaged or in an enclosed vehicle trailer.
The CFA office must be notified at least 24 hours in advance of any material deliveries not related to active, approved construction which may use trucks having 3 or more axles. This includes, but is not limited to, gravel, concrete, landscaping materials, and lumber. No damage deposit is required.
Clotheslines and other unsightly appurtenances must be placed at the rear of the dwelling.
Discharging firearms of any kind is prohibited within Carolina Forest.
Hunting by any means is prohibited within Carolina Forest.
No noxious or offensive activity is permitted on any lot.
No signs of any type are permitted inside CFA with the exception of 911 addresses, Security signs, Neighborhood Watch, and signs belonging to the Association.
CFA amenities, such as the Marina, Clubhouse, Campground, Recreation Areas, or any other property or facilities owned by CFA designated as an amenity, are reserved for the exclusive use of CFA Members and their Guests. Non-Members are not permitted to use Carolina Forest amenities. Non-Member owners become Members when all fees and assessments are paid in full. Membership status and privileges are more fully described in the Association Bylaws.
In the event of a violation of CFA’s Rules and Regulations, except as may be specified otherwise therein or by law, a Notice will be sent to the violator, and the Notice may be posted, if applicable. If the violation is not rectified within the time period specified in the Notice, CFA may levy a fine against the violator, and/or CFA may remedy the violation at the violator’s expense. All fines and costs so incurred may be collected in the same manner that annual fees are collected.
